These general terms and conditions apply to sales made directly on builders-of-the-ancient-mysteries.com, and in particular to virtual tours, digital content and support products offered by JAYAN FILMS.

General terms and conditions of sale

The publisher of the website https://builders-of-the-ancient-mysteries.com, JAYAN FILMS, offers digital content for sale, including virtual tours of the Barabar and Nagarjuni chambers and support products.

Sales made by JAYAN FILMS are governed by these terms, available at any time on the website. Placing an order implies their acceptance, without prejudice to the statutory rights of consumers, in particular the right of withdrawal where applicable.

Placing an order

Customers may order directly on the website. Payment is made by bank card or by any other payment method offered at the time of ordering, through the secure Stripe payment system.

The order is registered upon receipt of payment and is confirmed by e-mail. Customers are advised to keep this e-mail together with their order summary.

Product information

JAYAN FILMS presents the essential characteristics of the products offered: nature of the content, theme, duration where applicable, viewing technology or format, and price.

Images and illustrations are presented with the greatest care. They may nevertheless show minor differences in presentation which do not affect the essential characteristics of the product. In the event of a manifest error in a product description, customers may contact JAYAN FILMS before placing their order.

Prices

Prices are expressed in US dollars, inclusive of all applicable taxes.

JAYAN FILMS is a company established in France. Value added tax is applied in accordance with the tax rules applicable to the supply of digital services, which may vary depending on the customer’s country of residence. The tax amount actually applied to an order is shown before the order is finally confirmed, and appears on the invoice or order confirmation.

Any charges applied directly by the customer’s own bank or payment provider, including currency conversion fees, are not invoiced by JAYAN FILMS.

Payment terms

Orders are payable in full at the time of validation. Access to digital content is provided only after payment has been received in full.

JAYAN FILMS may suspend or refuse an order in the event of a payment incident, suspected fraud, abnormal order or a dispute relating to a previous order, in accordance with applicable law.

Delivery of digital content

The products sold on this website are digital and are supplied without a physical medium.

After payment has been confirmed, the customer receives an e-mail containing a PDF document with a clickable link giving access to the content purchased. This e-mail is sent to the address provided by the customer when ordering.

Customers must check that their e-mail address is accurate and complete. JAYAN FILMS cannot be held responsible for non-receipt resulting from an incorrect address supplied by the customer, or from filtering by the customer’s e-mail provider. If the e-mail has not been received, customers are invited to check their spam folder and then to contact contact@bam-investigations.com.

Right of withdrawal — digital content

For digital content supplied without a physical medium, the right of withdrawal is lost where performance has begun before the end of the withdrawal period, following the customer’s prior express consent and acknowledgement that the right of withdrawal will thereby be lost, and where confirmation has been provided on a durable medium.

Where these conditions are not met, the consumer retains a period of 14 days from the conclusion of the contract in which to withdraw, without having to give any reason.

Withdrawal may be notified by e-mail to contact@bam-investigations.com, or by any other unambiguous statement.

Refunds

Where the right of withdrawal is validly exercised, JAYAN FILMS will refund all sums paid by the customer no later than 14 days from the date on which JAYAN FILMS was informed of the decision to withdraw.

The refund is made using the same means of payment as that used for the order, unless the customer expressly agrees to another means involving no additional cost.

Legal guarantee of conformity

Digital content supplied by JAYAN FILMS benefits from the legal guarantee of conformity.

Where the digital content is not in conformity with the contract, the consumer may require it to be brought into conformity, without cost and within a reasonable period. Where this is impossible, or where it is not carried out within a reasonable period, the consumer may obtain a price reduction or termination of the contract, under the conditions provided for by the French Consumer Code.

To exercise this guarantee, customers may contact JAYAN FILMS at contact@bam-investigations.com, providing proof of purchase and a description of the problem.

Intellectual property

All content sold on this website, including virtual tours, films, images and accompanying documents, remains the exclusive property of JAYAN FILMS. Purchase grants the customer a personal, non-transferable right of access for private use only. Any reproduction, distribution, public communication or commercial use is prohibited without the prior written authorisation of JAYAN FILMS.

Voluntary support contributions

The “I SUPPORT YOU” option is a voluntary contribution in support of the productions of JAYAN FILMS. It is not a purchase: no product, service or other consideration is provided in return.

As it does not constitute a contract of sale, the provisions of these terms relating to the right of withdrawal, to conformity and to refunds do not apply to voluntary contributions.

Contributions are made freely and are non-refundable, save in the event of a manifest error or a duplicate transaction. In such cases, please contact contact@bam-investigations.com.

Applicable law and dispute resolution

These terms are governed by French law, without depriving consumers residing in another State of the mandatory provisions more protective of their interests which may apply in their country of residence.

In the event of a difficulty, customers are invited to contact JAYAN FILMS first in order to seek an amicable solution.

Personal data collected in connection with orders is used to manage and process those orders, handle payment, deliver the content, provide customer service and comply with the legal obligations of JAYAN FILMS.

Customers may exercise their rights of access, rectification, erasure and restriction and, where the conditions are met, their rights to object or to data portability, by writing to contact@bam-investigations.com. They may also lodge a complaint with the CNIL, the French data protection authority.
